Facts

On June 27, 1997, the defendants permitted the plaintiff's decedent, age 80, who is known to have a dementia to wander from the elder care facility where they were supposed to be watching her. The decedent fell and fractured her hip and subsequently died on July 29, 1997.

Settlement Discussions

The plaintiff demanded $450,000. The defendant offered $100,000.

$50,682.96 (medical, funeral and burial expenses)

Other Information

The case settled approximately one year and three months after the case was filed. At the time of the incident, the defendants' home care license was suspended. After the incident, the license was revoked.
