Facts
On Nov. 13, 1996, plaintiff was rear-ended on State Route 241 in Orange County. Plaintiff was a 38-year-old with a history of diabetes. She visited the emergency room on the day of the accident, but received no additional medical care for six months. Plaintiff eventually received two months of therapy. She was discharged from therapy when she was 80 to 90 percent improved. Six months later, she returned to the doctor, complaining about her neck and left shoulder. After weeks of physical therapy, she underwent left shoulder arthroscopy, but it did not eliminate the pain. She eventually received facet injections, which did not relieve the pain. She is currently undergoing physical therapy.
