Facts

On March 26, 1997, the plaintiff, owner of Victoria Electric, was utilizing a mechanical trenching device at the Chevron Training Facility in La Habra. The plaintiff had contracted to install low voltage irrigation and parking lot lighting. While trenching, the machine made contact with an underground high voltage electrical line owned by defendant Southern California Edison Company, but installed by defendant Assured Electrical Contractors, Inc. The plaintiff sustained first through third degree burns to his face and neck, and claimed to have suffered a photic injury to his left eye, which was a permanent disability.

Settlement Discussions

The plaintiff made C.C.P. º998 demands of $2 million to Edison and $2 million to Assured Electrical Contractors and Chevron USA, Inc. Southern California Edison made a C.C.P. º998 offer of a waiver of costs. Assured Electrical Contractors and Chevron USA, Inc. offered a waiver of costs.
