Facts

Plaintiffs (and the class they represent) are deaf or hard of hearing persons who have interacted, as persons in custody, or as relatives of persons in custody, with the Santa Clara County correctional facilities. The defendants are the operators and administrators of services, programs, and activities related to correctional facilities in Santa Clara County.

Other Information

The settlement was reached approximately one year and two months after the case was filed. A settlement hearing was convened from August through December of 1998 before the Chief Magistrate Edward Infante, of the USDC Northern, resulting in approval of a settlement on June 11, 1999. The court held that the Prison Litigation Reform Act's cap on attorney's fees did not apply to this lawsuit as it was primarily based on the ADA and Rehabilitation Act Claims, which have their own fee shifting provisions. As a result, the settlement includes, injunctive relief in addition to the $72,000 in damages and $206,296 in fees and costs.
