Plaintiff Arin Solomon,was driving his motorcycle northbound on Figueroa and was stopped at a traffic light at the intersection of Figueroa and 190th Street waiting to take a left turn onto 190th Street. While stopped at the light, a fluid was dripping from the right rear of the Los Angeles County Metropolitan Transportation Authority (LACMTA) bus idling in front of him. When plaintiff followed the bus into the intersection, he lost control of his motorcyle due to some type of slippery substance in the roadway. It was this substance that he claims caused the injuries and damages that resulted from the accident.

Settlement Discussions

The plaintiff demanded $120,000 before trial, which was reduced to $60,000 on the first day of trial. The defendant offered a $50,000 settlement package.

Injuries

The plaintiff suffured a fractured collarbone, separated shoulder, and a fractured ankle. Plaintiff, through his medical expert, contended that his talus bone was dying due to lack of blood, a condition known as a vascular necrosis. As a result, a future fusion of plaintiff's ankle was required. Plaintiff's doctor testified that this procedure would cost between $50,000 and $60,000.
