Facts

On Feb. 14, 1998, in a driving rainstorm, the plaintiff, a 58-year-old mail carrier, was operating his 1994 Aerostar northbound on the I-5 freeway, near the 118 transition. His vehicle developed mechanical problems and he came to a stop in the right hand emergency lane with his emergency lights activated. Approximately five minutes later, while in the process of calling 911 from his car phone, the plaintiff was rear-ended by defendant and pushed forward into an adjacent brick retaining wall.

Settlement Discussions

The plaintiff made a settlement demand for $100,000, representing the defendant's policy limit which was ultimately accepted.
