Facts
On July 22, 1997, the plaintiff, a 43-year-old flight attendant, was operating her 1987 Toyota Supra at approximately 40 mph in the northbound No. 2 lane of Inglewood Boulevard, approaching 170th Street in Lawndale. The intersection of Inglewood Boulevard and 170th Street is controlled by stop signs posted at the east and west corners of 170th Street. The defendant, a Los Angeles County Sheriff's officer, was traveling westbound on 170th Street under Code 3 (with his red lights and siren activated), responding to a request for assistance from a sister unit. According to the plaintiff, the sheriff's vehicle failed to stop or slow down at the east limit line and entered the intersection at speed in excess of 40 mph, striking plaintiff's vehicle. The force of impact caused the plaintiff's vehicle to veer across Inglewood Boulevard, thereby coming in contact with a brick wall and adjacent apartment building.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand of $69,000. The defendant made an initial offer of $30,000.
Damages
The plaintiff claimed medical specials in the sum of $5,902 and loss of earnings in the sum of $1,989 (highly disputed).
Injuries
The plaintiff sustained a fracture of her left fifth metacarpal, in addition to a contusion of the ribs and cervical sprain.
Other Information
The settlement was reached approximately one year after the case was filed.
