Facts
On July 7, 1995, Pangborn Plumbing Corporation retained Peter D. Weir, a California accountancy corporation, to prepare reviewed financial statements for the periods ending June 30, 1995 and June 30, 1996. On July 8, 1998, plaintiff Insurance Company of the West sued defendants, Pangborn Plumbing Corporation, Ronald Pangborn and Madeline Pangborn alleging various causes of action seeking indemnity based on a surety agreement. On Aug. 18, 1998, Pangborn Plumbing Corporation, Ronald Pangborn and Muriel Pangborn filed a cross-complaint against cross-defendants Peter D. Weir, a California accountancy corporation, and Peter D. Weir, an individual, for professional negligence and fraudulent non-disclosure, alleging that reviewed financial statements prepared by cross-defendants for 1995, 1996 and 1997 were inaccurate.
