Facts

Eleven homeless L.A.-area veterans brought suit against the U.S. Department of Veteran Affairs on behalf of a class of homeless veterans with mental disabilities and/or brain injuries, seeking access to mental health and other services, and to address the appropriate use of land donated for the benefit of veterans.

Result

The court denied in part the government's motion to dismiss and ruled that the Department of Veteran Affairs has an enforceable legal obligation to ensure that homeless individuals with severe mental disabilities can meaningfully access mental health and other services, including psychiatric and medical services they require to heal the wounds of war.

Other Information

Litigation will also proceed on the veterans' claim that the VA has not made appropriate use of the West LA VA campus.
