Facts
On Dec. 8, 1996, plaintiff Scott Irvine, a 28-year-old salesman, while on board a Carnival Cruise Ship, and Gary Lacy, became involved in a fight in the men's bathroom. Defendant Larry Lacy entered the bathroom and joined in the altercation. During the course of the incident, the defendant bit the nose off of the plaintiff's face. The plaintiff brought this action against the defendant based on intentional infliction of emotional distress, negligent infliction of emotional distress, assault, battery, Mayhan and false imprisonment.
