On May 21, 1996, the plaintiff, Alan Markow, a 27-year-old studio carpenter, returned home from shopping, stepped through the back door of his apartment into the kitchen and his foot went through the floor for 6-inch drop, and twisted his ankle, which had been fused 6 years before. The plaintiff brought this action against the defendants based on negligence.
