Plaintiff Grace Mitchell, an 80-year-old retiree, was a tenant of defendant Anthony Mersola for 15 years. On June 29, 1997, plaintiff was talking to two other tenants, saw the manager, who returned home from shopping and ran to stairs to remove trash bag on the stair landing. After retrieving the bag and descending the stairs, the plaintiff fell on the landing near the mail boxes. The plaintiff claimed that there was 2-inch of water from leaking hose or hose sprayed water by small child playing with the hose. The plaintiff brought this action against the defendant based on premises liability and dangerous condition.
