On Dec. 5, 1995, plaintiff Richard Hamilton, an employee of the defendant, tested positive for a very low amount of THC-metabolites on a random drug test. He was fired on Dec. 29, 1995, for testing positive for a controlled substance. The plaintiff brought this action against the defendant based on ADA/FEHA (failure to accommodate perceived handicap).
