Facts

On Sept. 15, 1997, plaintiff Dakota Produce Building Co. leased a portion of its industrial warehouse to defendants Marco Moreno and M&M Distributors, a California corporation, which is owned soley by Marco Moreno. The lease was for a term of four months from Oct. 1, 1997, through Jan. 31, 1998, at $13,500 per month plus certain common area maintenance expenses. The defendants cross-complained for breach of contract, tortious breach of covenant of good faith and fair dealing, fraud and negligent misrepresentation.

Other Information

A mediation was held before Jennifer Alter on Dec. 1, 1998, which did not result in a settlement. On Sept. 8, 1999, a voluntary settlement conference was held before the Hon. Rodney E. Nelson. The plaintiff indicated a willingness to settle its claims for approximately $50,000. The defendants offered mutual dismissals.
