Facts

In September 1998, the plaintiff was a back seat passenger in a vehicle driven by a family member. The vehicle was going southbound on the 57 freeway in the car pool lane. A disabled vehicle had stopped in the car pool lane just ahead of plaintiff's vehicle. The plaintiff's vehicle made a complete stop and was rear-ended by a third vehicle. The plaintiff claimed that the defendant was negligent for failing to observe their vehicle and crashed into them from the rear.

Injuries

The plaintiff suffered a lacerated lower intestine which required surgical repair and sustained various soft-tissue injuries. The plaintiff was left with a permanent scar over her abdomen.
