Facts

Defendant Lisa Grote was a fiduciary and a trustee of the Thomas Moore Family Trust. While in that capacity, she embezzled approximately $121,000 from her former father-in-law Thomas Moore and the trust. Defendant converted the assets of pliantiff Thomas R. Moore and the trust. Defendant's business, LMG Secretarial Service received assets wronfully taken from plaintiff by defendant Lisa Grote.

Settlement Discussions

The defendants offered to settle for $34,000.

Damages

The plaintiff requested the jury to award $171,906 for financial loss and $171,906 for pain and suffering for a total of $343,812. The jury awarded plaintiff $399,999, which was $56,186 more than asked for by the plaintiff.

Other Information

The plaintiff is taking a partial appeal as to the directed verdict in favor of Douglas Grote. The verdict was reached eight months after the case was filed.
