The plaintiff claimed that defendant prevented it from completing a notebook computer design contract by failing
to proceed with BIOS Porting and that defendant breached the covenant of good faith and fair dealing by
preventing plaintiffÆs performance and then refusing to pay the contract price.
The plaintiff brought a related claim for fraud.
The defendant contended that the plaintiffÆs alleged delay in designing the computer was a breach that excused
the defendantÆs obligation to pay.
