Facts

Plaintiff, a 35-year-old unemployed man, was a pedestrian walking along Tujunga Canyon Boulevard when he stepped out into a moving lane of traffic and was struck by the defendant's 1994 Jeep Cherokee. The accident occurred on a curve in the roadway. The plaintiff sustained brain damage and was unable to recall the facts of the accident. There were no independent witnesses. The defendant claimed that plaintiff walked directly in front of her vehicle.
