Facts

Decedent, Rene Garcia had successful abdominal surgery. However, he was respirator-dependent during his recovery period. While respirator-dependent in the intensive care unit, his ventilation tube became disconnected from the respirator. This went unnoticed for a substantial period of time because of understaffing in the intensive care unit.
