Facts

The case results from a two-vehicle accident that occurred on April 17, 2000 at approximately
2:30 p.m. on a day on which it had been raining on Palos Verdes Drive East in Rancho Palos
Verdes. The plaintiff and her grandson were traveling, southbound, up the hill, at approximately
15-20 mph. Palos Verdes Drive East is a winding two lane street. As they came to a curve in the
road, they saw the defendantÆs vehicle speeding around the corner and out of control. The
plaintiff veered to the right and tried to speed up but she could not avoid the collision as the
defendantÆs large Mercedes came across the center divider and crashed into the plaintiffÆs small
Mercury Topaz. The MercedesÆ first impact was to the rear of the plaintiffÆs vehicle causing the
Topaz to spin around and then the defendantÆs vehicle smashed into the front of the plaintiffÆs
vehicle.

Settlement Discussions

The defendants offers ranged from nil to $85,000. The plaintiffs' attorney submitted demands of $100,000 for adult plaintiff and $50,00 for minor plaintiff.

Injuries

The adult plaintiff suffered cervical sprain/strain and ruptured right breast implant. She required psychological consultation, physical therapy and was recommended to replace her breast implant. The minor grandson suffered head contusion, right shoulder sprain and underwent physical therapy and psychological consultations.
