Facts
The plaintiff, Astral Microelectronic Corp., was a wholesale distributor of computer products. The
defendant, Sibra International Inc. also was a wholesale distributor of computer components that
shipped goods overseas to South America. The defendant, Vincent Li, was the president, chief
financial officer and chief executive officer of Sibra. In April 1999, Li, on behalf of Sibra placed
orders to buy various computer components from Astral. Astral delivered and invoiced Sibra for
$567,000 worth of computer equipment with payment due in 45 days. Sibra paid only $67,000 on
the invoices, and ultimately refused to pay the remainder after numerous promises to do so.
Sibra claimed that the majority of the computer components supplied by Astral were defective.
Settlement Discussions
The plaintiff made a C.C.P. Section 998 demand of $450,000 with a waiver of attorney fees and costs. Sibra made no offer.
Other Information
Defendant Vincent Li abandoned the case before trial. At trial, no witnesses, including expert witnesses, testified for the defendant.
