The plaintiff hired the defendant to supply tile for use in a multi-million dollar development in Las
Vegas. The defendant was paid $141,000 by the plaintiff to deliver tile to the project, but one
week after receiving payment, he made out a check for $100,000 to an entity related to the
project manager at the site.

The court held that the defendant acted unreasonably in making a payment (an alleged refund) to an alleged agent of the plaintiff.
