Facts
On March 31, 2001, the decedent, Joseph Evans, aged 57, slapped his adult daughter and then pointed a large
kitchen knife at her. The daughter then went to a neighborÆs house and called the police reporting the incident
and the fact that the police had recently been called when the decedent had attempted to choke her. The
deceased had a history of mental illness and had been prescribed medication for his condition which he
periodically failed to take. After Gardena police arrived, the decedent refused to come out of his home. The
police did not call a mental health team to the scene nor did they obtain a Ramey warrant. The police kicked a
large hole in the front door of the decedentÆs residence and then they shot a bean bag shotgun into the house
striking the decedent. Shortly, thereafter, the decedent exited his house and approached the police branishing
the large kitchen knife whereupon he was shot with bean bag and taser weapons and almost simultaneously
shot to death with hand guns. The shooting took place exactly one hour after the initial call.
