Facts

On Jan. 22, 1997, in Oakland, the plaintiff was crossing the street when she observed two youths
walk past her. Less than a minute later, she heard gunshots and the two youths ran past her in
the opposite direction. The plaintiff turned toward the source of the shots when she was struck in
the neck by a stray bullet. The plaintiff received medical treatment for the wound and recovered.
Neither the youth nor the gunman have been located.
