Facts
On Oct. 5, 1999, the plaintiffs brought their 19-month-old son to the defendant for treatment of a fever and cold.
The decedent was diagnosed with a bacterial ear infection, treated with Amoxicillin and told to return 10 days
later for follow up.
On Oct. 18, the plaintiffs returned saying their son was appearing worse. The decedent was diagnosed with a
viral upper respiratory infection and told to return if he does not improve.
On Oct. 28, the plaintiffs returned, claiming their son was worse, with a fever of 102 degrees. The decedent
was again diagnosed with a viral infection and was told to return in four to five days if no improvement.
On Nov. 2, the plaintiffs again returned, at which time the decedentÆs temperature was 102.4 and he appeared
worse. The decedent was diagnosed with a bacterial infection and given a prescription for antibiotics and sent
home.
The following morning, the decedent was brought back to the defendant, in worse
condition after a seizure. He was transferred to Children'sÆ Hospital where he was declared brain
dead that afternoon secondary to bacterial meningitis and sepsis. The decedent passed away the
next morning.
