Facts

The plaintiff allegedly fell and was trapped inside an elevator at the Encino Financial Center. Her husband
suffered emotional distress in the course of witnessing the aftermath of the event. The plaintiff had severe pain
in her left foot as a result of a fall inside the elevator. She had had surgery on her foot one month prior to the
incident. She also suffered emotional distress as a result of being trapped in the elevator for approximately 45
minutes.
The defendant contended that the plaintiffÆs injuries pre-existed the elevator incident and her husband had no
basis for making an emotional distress claim.

Settlement Discussions

The plaintiffs initially demanded in excess of $50,000 collectively. The defendants offered a total of $10,000 at the mandatory settlement conference.
