Facts

The plaintiffÆs decedent was bedridden and required home companion care. She also received regular home
nursing care.
The defendant Interim Assisted Care assigned one of its employees to act as a
companion to the decedent for the purposes of cooking, cleaning and feeding. The decedent
choked on a piece of food and the home companion called 9-1-1. The decedent lapsed into a
coma for approximately ten days and subsequently died.
