PLAINTIFF'S CONTENTIONS:
Realtek argued that defendants breached its contractual obligations to the Institute of Electrical and Electronics Engineers Standards' Association. Realtek was a member of the Association. Defendants broke various promises made to the Association by refusing to offer a licensing agreement to Realtek, despite agreeing to provide a license on reasonable and non-discriminatory terms.

Result

Plaintiffs were awarded $3,825,000 and the jury determined the reasonable royalty rate for two patens at 0.12 and 0.07 percent.
