On Nov. 13, 2001, at 7:30 a.m., Margarita Jaramillo, 55, and her daughter Leticia Jaramillo, 13, were traveling on Third Street in Riverside in their 1976 Ford Elite. As they passed through an intersection controlled by four-way stop signs, their vehicle collided with a 1998 Chevrolet Malibu driven by Terri Ann Buberge. The Chevrolet was owned by Betty Arceneaux. The Jaramillos sued Buberge and Arceneaux, alleging vehicular negligence.

Settlement Discussions

The plaintiff made a C.C.P. Section 998 demand of $25,000 policy limits. The defendant offered nothing.

Injuries

Plaintiff Margarita Jaramillo claimed she suffered a herniated disc at L5-S1. Her daughter Leticia claimed she suffered soft-tissue injuries to her neck and back.
