Facts

On Dec. 30, 1999, the plaintiff, Clark Weaver, a 32-year-old aspiring male actor, was driving a 1991 Black Saab convertible in Melrose with his two friends as a passenger. The plaintiff testified that he was in the number 1 lane until about 100 feet before the intersection and then made a lane change to the number 2 lane and tried to make a right turn when he was rear ended by the defendant, driving his girlfriends' 1997 Honda Accord. One of the two female witnesses said that they had been in the number 2 lane for two blocks and the other said the whole time. The defendant stated that he was driving eastbound on Melrose in the number 2 lane when he first saw the plaintiff stopped behind another vehicle in the number 1 lane and then suddenly made a lane change into his lane short of the intersection. The right rear part of the Saab came into contact with the left side front fender of the Honda and both cars ended up one on the other side of the street and the defendant in the middle.

Settlement Discussions

The plaintiff demanded $4,200; the defendant offered zero dollars. A prior arbitration award awarded the plaintiff $5,500.
