On Feb. 28, 2003, the plaintiff was riding his motorcycle on the 805 freeway ramp in San Diego when he struck the rear of the defendant's car. The plaintiff claimed that the defendant cut him off. The plaintiff claimed that the defendant failed to yield to him. The defendant argued that the plaintiff was speeding and came out of nowhere.
