Facts

On Sep. 29, 1999, Imelda Doty, driving a 1993 Chevrolet Blazer registered to Ed Doty, rear-ended the Chevrolet pickup with camper shell driven by Ron Brown after Brown stopped due to rush hour traffic on I-5 near I-80 in Sacramento. The accident caused approximately $459 in damage to the rear end of Brown's truck, and approximately $2,000 in damage to the front of Doty's vehicle. Brown sued the Dotys, alleging vehicular and general negligence. The Dotys admitted liability, but disputed the nature and extent of Brown's injuries.

Specials in Evidence

$8,000

Injuries

Brown claimed injury to his back, including pain between his shoulder blades and a possible herniated disc at T8-9.

Other Information

Brown claimed a total of $468,000 in past and future economic losses, including lost wages, health insurance pension benefits, and future health care. The Dotys claimed that Brown's medical records admitted into evidence showed that he had seen his chiropractor before the accident for the same symptoms. Defense experts testified that the pain from a herniated disc at T8-9 would not manifest itself in pain between the shoulder blades, and that the accident could not have caused injury to Brown's thoracic spine.
