Tony Tamayo, a 61-year-old plumber, was driving his 1986 Toyota pickup truck in Milpitas on Sep. 1, 2000, when he was rear-ended by a 1996 Acura driven by Fred Kroh. There was $1,100 damage to Tamayo's truck and $600 damage to Kroh's car.

Injuries

Tamayo reported a ringing in his ears ten days after the accident. Otolaryngologist Niraj Lal diagnosed tinnitus, and confirmed he could do little to alleviate the ringing.

Other Information

Defense counsel reported that Tamayo admitted under cross-examination that he made up the 40 mph estimate of Kroh's speed at impact.
