Facts

On July 25, 2002, the plaintiff, a 19-year-old student, was driving his 1991 Honda CRX northbound in the number 2 lane of Pacific Avenue in Glendale. At the same time, the defendant Andre Davoodian, age 17, was driving south on Pacific in a 1997 Jeep Cherokee, co-registered to Vigen Davoodian. When the defendant entered the intersection of Pacific and California and attempted to make a left turn onto eastbound California, his vehicle collided with Asadorian's Honda, which had also entered the intersection, intending to go straight on Pacific. The plaintiff sued the defendants and alleged vehicular negligence. The defendant Andre Davoodian filed a separate personal injury lawsuit against the plaintiff in respect of personal injuries. Both cases were consolidated for trial.

Settlement Discussions

The plaintiff demanded $13,500; there was no offer.

Specials in Evidence

$4,360

Damages

$4,237 for property damage and car rental expenses of $595.

Injuries

The plaintiff claimed that he sustained soft-tissue injuries to his neck and back.

Other Information

Prior to trial, the defendant settled his separate personal injury action with the plaintiff's insurance carrier for an undisclosed amount. This left the plaintiff's cause of action against the defendants as the only claim to go to trial. The plaintiff filed a memorandum of costs and was awarded $3,138.
