The plaintiff, an employee of the defendant County of San Bernardino, claimed that the county had discriminated against him on the basis of his gender in violation of the Fair Employment and Housing Act when the county promoted a female employee to a supervisory position in March 2000, rather than the plaintiff. The plaintiff contended that he was more qualified than the successful candidate who happened to be the only female who competed for the position. The defendant argued that the successful candidate performed the best of all the candidates during oral interviews and that gender played no role in the promotion decision.

Damages

The plaintiff claimed $177,000 in economic damages and $300,000 in non-economic damages.

Result

The jury found that the county did not discriminate against the plaintiff on the basis of gender.
