Laurence Vinocur sued Sport Squad LLC, and others, for alleged violations of Proposition 65

Contentions

PLAINTIFF'S CONTENTIONS:
Defendant allegedly manufactured, imported, sold, or otherwise distributed vinyl/PVC racquet cases containing DEHP without the requisite Proposition 65 warnings.

DEFENDANTS' CONTENTIONS:
Defendants denied the allegations and maintained compliance with all laws at all times.

Result

Vinocur and Sport Squad entered into a consent agreement providing both injunctive and monetary relief. As part of the agreement, Sport Squad agreed to make available reformulated products and pay $2,500 in civil penalties. Sport Squad will also pay Vinocur $42,000 in reimbursement for costs and attorney fees.
