Facts
On July 25, 1995, the decedent, a 53-year-old project manager for Hughes Aircraft, was laid off from his job and suffered chest pains later that evening. He was taken by paramedics to the defendant emergency room where, after tests and observation, he was discharged with a diagnosis of musculo-skeletal pain with advice to see his family doctor the next day. On Friday, the next day, the defendant family practitioner saw the decedent. He performed no follow-up testing or EKG's and reassured the patient. On Monday evening of the next week, the decedent had a cardiopulmonary arrest and died before reaching a local hospital. The plaintiffs, the decedent's wife and adult son, brought this action against the defendant based on a negligence theory of recovery.
