Facts

Plaintiffs were 10 present and former tenants of the Arnette Apartments at 1080 Bush Street. Defendant William K. Benton is the primary owner of the building and his son Jonathan was a partial owner until late 1996. The plaintiffs claimed that conditions in the apartment building had been deteriorating for many years and the defendants failed to make routine repairs and plumbling and roof leaks damaged their ceilings and walls and that common areas were withouht lighting and garbage was pilled in the hall garbage rooms. The plaintiffs also claimed that the defendants also refused to make routine improvements to security and the intercom system was inoperative (plaintiff Molina was assaulted by a tresspasser) and that the defendants failed to maintain fire safety systems. The building was been cited by Fire Department and the Department of Building Inspection. The plaintiffs also alleged gas and electricity service has been terminated on several occassions because the defendant dit not pay the PG&E bill. The plaintiffs brought this action against the defendants based on negligence, nuisance, breach of warranty and habitability theories of recovery.
