Facts
On Nov. 11, 1994, plaintiff Chad McKeough, a 24-year-old waiter, was riding his bicycle westbound across Bristol against a red light, but in a crosswalk with a pedestrian "walk" light. Defendant Adriana Ruiz exited the South Coast Plaza at Anton, turning north on Bristol as the plaintiff was in the crosswalk. The bicycle and automobile collided in the crosswalk. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $15,000, reduced to $5,000 before trial. The defendant made a C.C.P. º998 offer of compromise for $3,500.
