On July 21, 1995, the plaintiff, a 27-year-old carpenter, was walking alongside a backhoe balancing an awkward gas pipe or front loader when the backhoe ran over his foot. The plaintiff was employed by the general contractor at a church construction site. The backhoe driver was uninsured. The plaintiff brought this action against the defendant based on negligence theory of recovery.
