Facts

On Aug. 19, 1997, the plaintiff, a 65-year-old retired woman, was a customer at the defendant car wash. The defendant car wash leased the premises from the defendant owner. An employee of the defendant car wash told the plaintiff to move back. The plaintiff complied and tripped in a hole left after a gas pump had been removed from an island. The plaintiff brought this action against the defendants based on premises liability and negligence theories of recovery.

The plaintiff claimed she suffered a knee injury requiring surgery.

Other Information

The settlement was reached approximately one year and eight months after the case was filed. A mediation was held on Nov. 7, 1996 before James Orendorf. It did not resolve the matter. The parties had a second settlement conference in which the case was settled.
