Facts

In 1995, the plaintiff insured made a claim for additional living expenses incurred as a result of the Northridge earthquake. The defendant insurance company denied the plaintiff's claims, arguing that the one-year contractual limitation period barred the claims. The plaintiff brought this bad faith action against the defendant based on breach of contract and breach of the covenant of good faith and fair dealing theories of recovery.
