The decedent was the passenger in a private aircraft taking off from a private airfield in Seattle, Wash. The defendant pilot erred and the plane stalled and crashed, killing both the pilot and passenger. The plaintiffs, the decedent passenger's wife and two minor children, brought this action against the defendant employer of the decedent and pilot based on a negligence theory of recovery.
Settlement Discussions
The plaintiffs made a C.C.P. º998 settlement demand for $3 million. The defendant estate of the pilot made a C.C.P. º998 offer of compromise for $750,000. The defendant company made no settlement offer.
