Facts

In 1978, the plaintiff, a maintenance man and factory worker, began working for defendant Jack Glicksman, now
92, as the maintenance man for three apartment buildings owned by Glicksman. The plaintiff was compensated
solely by receiving free rent in one of the apartments; a $250 monthly value. Glicksman became fond of the
plaintiff over the next 18 years and promised him, in the presence of witnesses, that he would have a job with
Glicksman for as long as Glicksman lived.
Glicksman further promised the plaintiff that he would will him $5,000 per year for each year
the plaintiff worked for him. Later, defendant Mercedes Posada, befriended Glicksman, and, in
1998, Glicksman executed a power of attorney that gave Posada power over his affairs. She
appointed herself apartment manager and gave her brother maintenance duties. She eventually
evicted the plaintiff.

Settlement Discussions

The plaintiff demanded $25,000 before trial and the defendants offered $5,000.

Damages

The plaintiff claimed $105,000 in lost earnings, as well as emotional distress.

Other Information

The court found that the Breach of Implied - In - Fact - contract, which was dismissed on demurrer , was proven at trial. The plaintiff represented himself in pro per up to two weeks before the trial.
