Facts

On Oct. 31, 1999, the plaintiff was driving eastbound on the first lane of the I-80 freeway in a cab he leased from
defendant Cab Company. The plaintiff was transporting passenger K. The automobileÆs engine failed, causing
it to die abruptly. The plaintiff and his passenger exited the cab and walked to the front of it to inspect the
cause of the failure. While the plaintiff and his passenger were in front of the cab, it was struck by another
automobile driven by defendant A.
The cab had recently been at the defendant Cab Company shop for repairs to the engine. The plaintiff
passenger believed that the faulty mechanical work was the cause of the accident. The plaintiffs further
believed that all the cab company defendants maintained and ran their companies out of the same shop in
Oakland giving rise to an alter ego issue.
The plaintiffs contended that the defendant Cab CompanyÆs faulty mechanical work was the cause of the
accident. The plaintiffs further alleged that all the cab company defendants maintained and ran their companies
out of the same shop in Oakland giving rise to an alter ego issue.

Settlement Discussions

The case originally settled for $1 million in November 2000 based on the belief that there was limited coverage. However, after determining that there was potentially more coverage available, the case settled for double the amount. The case was mediated before John Bates.
