Facts
On July 11, 1998, the defendant's vehicle struck the plaintiff's vehicle head-on. The plaintiff alleged that she was injured when a vehicle struck the vehicle in which she was a passenger. She claimed that her seat belt did not restrain her, and she was thrown into the dashboard. Sylvia Johnson died of unrelated causes in June 2000. Prior to her death, she admitted liability for the collision. The Estate of Sylvia Johnson denied causation and alleged that the plaintiff was not injured to the extent she claimed and was not injured in the way in which she claimed.
Settlement Discussions
There was a $60,000 final demand before trial and a $15,000 final offer of settlement.
Injuries
The plaintiff alleged a shoulder impingement, which required surgery as well as neck pain. The PIP carrier paid lost wages of $1,900 and past medical expenses of $10,095.
