Facts

On Feb. 5, 1999, the plaintiff was a tenant in an apartment building owned by the defendant owner and managed
by the defendant manager. The plaintiff was walking towards his apartment by the side of the building when
he was attacked and bitten by the defendant managerÆs pit bull, who was kept in the building despite lease
agreement terms prohibiting dogs. The defendant manager let the dog run loose in violation of Long Beach
Municipal Code Section 6.16.100 (leash law).
The plaintiff brought this action based on strict liability, respondeat superior and negligence theories of
recovery.

Settlement Discussions

The defendants accepted plaintiffÆs Code of Civil Procedure Section 998 demand for $49,995 approximately three months prior to trial.
