Warner Bros. Home Entertainment Inc. filed a copyright infringement action against Alex Keaton LLC, Jeremy Neumann dba Amazon.com Seller The Alex Keaton Co. in relation to several works, including television episodes of Band of Brothers, Big Love, Chuck, ER, John Adams, One Tree Hill, Pretty Little Liars, Shameless, The Big Bang Theory, The Vampire Diaries and True Blood.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged defendants made unauthorized uses of plaintiff's works or extremely similar likenesses or imitations of plaintiff's works. Plaintiff claimed that it owned distributions rights in various creative works that are entitled to copyright protection, and that that defendants used an online venue to offer for sale or sell counterfeit copies of these works. Plaintiff alleged that the conduct was systematic and willful or performed with reckless disregard to plaintiff's rights.

Result

The parties entered into a joint stipulation for the entry of a consent decree and permanent injunction. Under the injunction, defendants were required to refrain from infringing or inducing anyone to infringe plaintiff's works.
