Warner Bros. Home Entertainment Inc. filed a copyright infringement action against John Reed doing business as Amazon.com Seller Johnny's Toy Shop, in relation to alleged violations of its rights to several television program episodes, including episodes of Chuck, Curb Your Enthusiasm, Entourage, Falling Skies, Game of Thrones, One Tree Hill, Pretty Little Liars, Rizzoli & Isles, The Big Bang Theory, The Pacific, The Sopranos, The Vampire Diaries, The Wire and True Blood. Warner Bros. also has rights to the Harry Potter movies.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that defendant made unauthorized uses of plaintiff's works and that plaintiff owned or controlled the copyrights and distribution rights to these works. Plaintiff claimed that defendant used Amazon.com to market, offer, and distribute counterfeit products. Further, plaintiff alleged that this occurred in willful disregard of the law pertaining to plaintiff's rights.

Result

The parties entered into a joint stipulation for entry of a consent decree and permanent injunction, under which defendant was enjoined from copying plaintiff's works, or profiting from them.
