Defendants built a 50-unit condominium complex located in Thousand Oaks. The project was completed in 1988. The price per unit was between $300,000 and $325,000. Plaintiff homeowner association discovered construction defects and filed this suit.

Settlement Discussions

Plaintiffs contend they demanded $1,500,000 and Defendant offered $750,000.

Damages

Hillside flooding, drainage failure, and unconnected HVAC systems. Plaintiffs estimated the cost of repairs to be $1,500,000.

Plaintiffs settled out early with numerous subcontractor parties; settlement was reached with the developer wherein one carrier paid $600,000 and an assignment of bad faith was made against another non-participating carrier.
